5.2 Gardof Limited does not accept liability for any damages and losses that are alleged to have occurred, whether or not the Company or its suppliers were aware that such damages and losses were possible, or whether or not an initial legal action has been unsuccessful or is still in progress.

For instance, some states prohibit both the limitation on liability for “incidental and consequential damages” as well as the elimination of “implicit warranties.” In these cases, each party’s liability is limited to the amount permitted by that state’s law.

6.3 There is no express or implied warranty, representation, or warranty of any kind made by Gardof Limited or its associated suppliers for the following:

6.3.1 Service Functionality and Availability: This applies not only to how the service works and where it is available, but also to the tools, products, data and/or resources that make up the service.

6.3.2 Interruptions: The availability of the Service is not guaranteed to be without error or disruption, and it is possible that the Service may experience malfunctions or interruptions.

6.3.3 Accuracy of Information: The Company does not guarantee the accuracy, reliability, currency, or relevance of any information or content received through the Service.

6.3.4 Viruses and Malware: It is important to be aware that the Service, its servers, and the content of any emails or other communications sent on behalf of the Service or with the intent to provide the Service may be contaminated by malicious software, such as viruses, malicious malware, Trojan horses, or worms.

6.4 Certain jurisdictions may limit the extent to which a consumer's legal rights can be restricted or prohibit certain forms of warranty, meaning that certain or all limitations or exclusions outlined in this section may not be permissible. This section will only be applicable in cases where the applicable laws allow it; otherwise, it will not be effective.

Section 7. Relevant and Applicable Laws

7.1 These Terms and the Use of the Service, except as otherwise provided, shall be subject to the laws, regulations, and procedures of Cyprus, with the exception of those relating to conflict of laws.

Section 8. Resolution to Disputes

8.1 By using the Service, you agree to address any queries or problems you may have directly with the Company, and to first attempt to resolve any issues amicably.

8.1.1 For EU Consumers - EU consumers will also be subject to the laws and regulations of the EU country in which they are currently resident.

Section 9. Severability of Terms

9.1 In the event that any of the terms is declared invalid or non-enforceable, the other provisions of these Terms and Conditions shall continue to apply and shall be enforceable. To ensure compliance with this Section, amended sections shall be interpreted in such a way as to as closely as possible align with the other terms.

Section 10. Effect of Waivers 

10.1 A Party's failure to comply with the Terms shall not preclude the Party from exercising such a right or from requiring performance in the future, unless otherwise specified. The waiver of one breach shall not preclude the waiver of another breach in similar or analogous circumstances.

Section 11. Controlling Translation

11.1 If we have provided you with a translation of this Terms and Conditions in any language other than English via our Service, you acknowledge that, in the event of a dispute, the original English version of these Terms shall take precedence.

Section 12. Updates to the Terms

12.1 The Terms may be amended at any time by the Company. If there are substantial changes to the Terms, the Company shall notify you at least 30 days prior to the new Terms entering into force. The Company shall have the right to determine whether the alterations to the Terms constitute material changes to justify such notices.

12.2 By using our service or accessing it after the date of its effectiveness, you acknowledge receipt of the newly amended Terms and agree to comply with them. If the updated Terms are unacceptable to you, please discontinue the use of our website and Service.
